Terms of use
These terms cover this website and the services we sell. If we send you a written agreement, that agreement wins if anything conflicts.
Scope of services
Grupo Viadovela S. de R.L. de C.V. operates maxpec.digital under the Maxpec brand. We build and host websites for home service companies and provide the follow-up system and the weekly training described on this site. The plan, the deliverables and the term that apply to you are the ones in the written agreement we send. Submitting the contact form is a request for a conversation, not a contract.
Plans and prices
Prices are those published at /en/pricing (English, USD) or /es/pricing (Spanish, MXN plus IVA). The two lists are separate, not conversions of each other. In the United States there are three plans, which differ in the number of pages and in the automation included; every plan includes the site, hosting, unlimited updates as defined below, the lead alerts and Winning Wednesday. A written quote confirms the plan and the price before work starts. Moving to a larger plan during the term is a written request; the new price applies from the next payment and the term does not restart.
The payment plan
A plan in the United States is a twenty-four-month payment plan for the site: we do the work up front and you pay for it in twenty-four equal monthly payments, with no down payment, no interest and no build fee. The first payment is due the day you accept the quote, and work starts when it clears. The remaining twenty-three are billed one at a time, on the same day of each month; we do not ask for the balance up front. Hosting, maintenance and updates are included at no charge for the whole term. English-language work is billed in USD; Spanish-language work is billed in MXN plus IVA.
If a payment fails, we retry it for seven days and write to you. After fourteen days without payment the system pauses — the lead alerts, the number and the automation — while the site stays online. After thirty days hosting pauses too, and the term keeps running. Everything is switched back on the day the payment clears.
The fourteen days
The fourteen days to launch count from the day the first payment clears. Launch means the site is live on your domain. We build from what you give us at kickoff: your logo, photos, services, hours and the facts about your business. Anything we do not have by day seven that can be substituted, we substitute — licensed stock photography and copy written from our call — so the site still launches on day fourteen, and your own material replaces it when it arrives, as an update. Stock images are licensed for use on your site and are not delivered as separate files.
The fourteen days pause only for the things nobody can substitute: access to your domain or registrar, access to your Google Business Profile, your legal business name and EIN for texting, and your approval of the page. We ask for that approval in writing; if we hear no objection within three business days, the page is approved and we launch. We tell you in writing when the clock pauses and why.
Before launch you get two consolidated rounds of revisions on the design and the copy. Changes after that go in as updates once the site is live, so the launch date holds.
What you own
Your domain, your data and your Google Business Profile are yours from day one; we administer them for you while we work together and we do not hold them hostage. The website becomes yours once the twenty-four payments are made in full; if you leave before that, the rules under Cancellation apply. Until then we host it and it remains ours, which is what makes the guarantee below possible. “The files” means the site’s source and built pages — HTML, CSS, JavaScript and images — delivered as a download and a code repository; hosting, DNS and form delivery after that are yours to arrange, and we tell you what we used. Ad accounts and CRM records built for you are yours. Text, design, photographs, the Maxpec name and the Max mark on this site are ours or used with permission — you may link to the site and quote short excerpts with attribution, but do not copy the design, the photographs or the logo.
What you give us stays yours. You confirm that you own or have the right to use the logo, photos, text and reviews you hand us, that the claims on your site about licences, insurance and certifications are accurate, and you give us permission to use that material on your site and in the system while we work together. You are responsible for what your site says about your business; we are responsible for how it is built. Unless you tell us in writing that you would rather we did not, we may show your site on our Results page and in proposals, with your company name.
Cancellation
During the twenty-four months, ending early takes one of two forms. Pay fifty percent of the remaining balance, and the site comes down and the plan ends. Or pay the remaining balance in full, and you take the files. Either way you keep what you already own — the domain, the Google Business Profile, your data — and the system switches off after we export your contacts and lead history for you. Fees paid for work delivered are not refunded.
The one exception is the written guarantee. A client who is not happy with the site may ask by email, within thirty days of launch, for the return of the payments made; we return them within ten business days and the plan ends. The site is not part of a refund and remains ours; the carrier registration charge is not refunded once the registration has been filed, and a registration already made in the client’s name is not unwound; the domain and the Google Business Profile remain the client’s. Ask us before disputing a charge with your bank — a refund under the guarantee is paid faster than a dispute is decided.
After the twenty-four months
Nothing renews on its own. A month before the twenty-fourth payment we write to you with three choices: renew the same plan for another twenty-four months and receive a new design of the site at no additional cost during the first ninety days of the new term; continue month to month at the month-to-month price published at /en/pricing, with everything running and either of us able to end it by written notice, the month in progress being the last one billed; or take the files. If we do not hear back, the plan continues month to month and you may still choose either of the other two at any time. Before the system switches off we export your contacts and lead history to a spreadsheet and hand it to you. If you want to keep the business number, tell us before the end date and we release it for porting to a carrier of your choice; otherwise it is released thirty days after the system switches off.
Updates, upkeep and Winning Wednesday
Unlimited update requests means changes to the text and images of the pages you have — as many as you ask for, one request at a time, normally done within two business days. New pages are charged at the per-page price published at /en/pricing; new features and integrations are quoted; a redesign is quoted, except the one that comes with a renewal. During the term the site is kept working as agreed — every page, every form, and the performance standard on the homepage — at no charge; that is part of what the monthly payment buys, not an extra.
Winning Wednesday is a group call: we never show one client’s numbers, leads or customers to another, and we ask the same of you — what other clients say on the call stays on the call. The recording is for clients only.
Text messaging
Maxpec sends text messages only to people who have given consent: replies to an enquiry, notices about a call or an account, and marketing only where the separate marketing consent was given. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. Our privacy notice explains what we keep.
For client sites on the Deluxe and Premium plans, texting to the client’s customers starts once the client’s business is registered with US carriers (A2P 10DLC). We prepare and submit the registration for a fixed one-time charge published at /en/pricing, which covers the filing, the carriers’ monthly campaign fee for the term and any resubmission, and is not refundable once the registration has been filed; the client supplies the legal business name and EIN and keeps the consent language we build into the site and its forms. Messages to the client’s customers are sent in the client’s name; the client is the sender, texts only people who consented through the site or in person, honours every STOP, and is responsible for the messages sent from its number. We may pause messaging on a carrier complaint until it is resolved. Approval times are set by the carriers, and approval can be refused; the charge covers the filing either way. The monthly carrier campaign fee after approval is covered by that charge. The number on the client’s site is a tracking number that forwards to the client’s own phone; it is not a telephone service and carries no unlimited minutes. The Deluxe plan includes five hundred outbound text segments a month through the system and the Premium plan one thousand, and both include three hundred minutes a month of calls forwarded through the number; unused allowance does not carry over. Usage beyond the allowance is billed to the client at what the carriers charge Maxpec, without markup, on the next monthly invoice; Maxpec tells the client when usage passes the allowance and may pause outbound texting when it reaches twice the allowance until the client confirms it. In Mexico, the plan includes one thousand WhatsApp messages a month sent through the system, replies within twenty-four hours of a customer’s message not counted; above that, at what Meta charges Maxpec, without markup, on the next monthly invoice.
Limitation of liability
The site is provided as is. Results on the Work page are published with the client’s permission and show percentages only — they are not a promise of what your business will do. To the extent the law allows, we are not liable for lost profits or other indirect loss arising from using the site or from the services, beyond the fees you paid us for the period in question. Nothing here limits liability that cannot be limited by law. Neither of us is responsible for delay caused by events outside our reasonable control, and neither of us may assign the agreement without the other’s written consent, except that we may assign it to a successor of the business.
Governing law
These terms are governed by the laws of Mexico, with jurisdiction in the courts of Mérida, Yucatán, without prejudice to consumer protections that apply where you live. A written agreement with a client in the United States may name a different governing law and venue.
